1. BOOKING CONFIRMATION & ACCEPTANCE

By confirming a booking with Attraccion De Turismo Travel & Tours (“the Agency”), the client acknowledges and agrees to all terms and conditions stated herein.

A booking is considered confirmed once:

  • The client has provided full or partial payment, and
  • The Agency has issued a booking confirmation, invoice, or itinerary.

All confirmed bookings constitute a binding agreement between the client and the Agency.


2. PAYMENT TERMS

  • Full payment is required upon confirmation unless otherwise stated in writing.
  • In certain cases, a deposit may be accepted to secure the reservation; however, balance must be paid before travel deadlines set by the Agency or suppliers.
  • Failure to complete payment within the specified timeframe may result in automatic cancellation and forfeiture of payments made.

The Agency reserves the right to:

  • Cancel unpaid bookings
  • Adjust pricing due to supplier changes, currency fluctuations, fuel surcharges, or government-imposed fees prior to full payment

3. PRICING & INCLUSIONS

All prices:

  • Are based on current supplier rates and availability
  • May change without notice until full payment is received

Packages typically include only those items specifically listed in the confirmed itinerary.

Not included unless stated:

  • Travel insurance
  • Visa fees
  • Personal expenses
  • Optional tours or upgrades
  • Additional baggage or airline fees

4. CANCELLATION POLICY

All cancellations must be submitted in writing.

Cancellation charges apply as follows:

  • More than 10 days prior to travel: Subject to supplier cancellation policies and administrative fees
  • 10 days or less before travel: 100% non-refundable

In all cases:

  • Refunds are subject to supplier policies (hotels, airlines, tour operators)
  • The Agency is not responsible for supplier-imposed penalties
  • Processing fees, bank charges, and service fees are non-refundable

5. NO-SHOW / UNUSED SERVICES

  • No-shows, late arrivals, or unused services are non-refundable
  • Any missed tours, transfers, or accommodations due to personal reasons are the client’s responsibility

6. CHANGES & MODIFICATIONS

Any request for changes (dates, names, itinerary, etc.):

  • Must be made in writing
  • Is subject to supplier approval and applicable fees
  • May result in price adjustments

The Agency does not guarantee that modifications can be accommodated.


7. TRAVEL DOCUMENTS & REQUIREMENTS

The client is solely responsible for:

  • Valid passports (minimum 6 months validity)
  • Visas and entry requirements
  • Health documentation or vaccinations
  • Compliance with immigration and customs regulations

The Agency is not liable for:

  • Denied boarding
  • Entry refusal
  • Travel disruptions due to incomplete or invalid documentation

8. TRAVEL INSURANCE

Travel insurance is strongly recommended but not included unless specified.

The Agency shall not be responsible for:

  • Medical emergencies
  • Trip cancellations
  • Loss of baggage
  • Personal accidents

Clients are encouraged to obtain comprehensive travel insurance coverage.


9. LIMITATION OF LIABILITY

The Agency acts only as an intermediary between the client and third-party service providers (including but not limited to airlines, hotels, transport companies, and tour operators).

The Agency shall not be held liable for:

  • Acts, errors, omissions, or negligence of suppliers
  • Delays, cancellations, or schedule changes
  • Injury, illness, accident, loss, or damage to persons or property
  • Overbooking or service disruptions
  • Mechanical failures or transportation issues

10. FORCE MAJEURE (FORTUITOUS EVENTS)

The Agency shall not be liable for any failure or delay in performance due to circumstances beyond its control, including but not limited to:

  • Natural disasters (typhoons, earthquakes, floods)
  • Weather conditions
  • Pandemics or health emergencies
  • Government restrictions or travel bans
  • Civil unrest, strikes, or acts of terrorism

In such cases:

  • Refunds or credits are subject strictly to supplier policies
  • The Agency will assist in coordination but does not guarantee recovery of funds

11. DURING TRAVEL

Clients are responsible for:

  • Following local laws and regulations
  • Respecting hotel and tour policies
  • Arriving on time for all scheduled services

The Agency reserves the right to:

  • Remove or refuse service to any client whose behavior is disruptive, unsafe, or unlawful without refund

12. ACCOMMODATION & TOURS

  • Accommodation is subject to availability at the time of booking
  • The Agency reserves the right to substitute hotels or services of similar category if necessary
  • Tour itineraries may be adjusted due to operational, safety, or weather conditions

13. CLAIMS & COMPLAINTS

Any issues during travel must be reported immediately to:

  • The Agency, and/or
  • The local supplier

Failure to notify during travel may affect the ability to resolve claims.

All post-travel complaints must be submitted in writing within 7 days after return.


14. DATA PRIVACY

The Agency collects personal information solely for booking and operational purposes.

Client information may be shared with suppliers as necessary to fulfill travel arrangements.

All data is handled in accordance with California privacy regulations.


15. GOVERNING LAW

These Terms & Conditions are governed by the laws of the State of California, USA.


16. ACKNOWLEDGMENT

By confirming and paying for the booking, the client acknowledges that:

✔ They have read, understood, and agreed to all Terms & Conditions
✔ They accept all supplier policies and limitations
✔ They understand the risks associated with travel


17. CHARGEBACK & DISPUTE POLICY

Client agrees not to initiate chargebacks without first contacting the Agency for resolution.

Unauthorized chargebacks for valid services rendered may result in:

  • Legal action
  • Recovery of associated fees
